Terms of Service

By accessing or using Aioby ("the Platform") at aioby.com, aioby.in, or aioby.app, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Platform.

Aioby is a social marketplace platform connecting local businesses and communities in India and the UAE. We operate as an intermediary platform — we are not the seller, service provider, employer, or landlord for any listing on the Platform. Buyers and sellers, customers and businesses, applicants and employers deal directly with each other; Aioby does not buy, sell, ship or deliver anything and is not a party to those dealings.

Aioby is an intermediary as defined under Section 2(1)(w) of the Information Technology Act, 2000 (India). Aioby does not initiate, select, or endorse the content posted by users, businesses, or third parties on the Platform, and does not edit it except as described in these Terms (for example the AI features in section 10, formatting and moderation).

All listings, posts, reviews, business profiles, and other content on the Platform are created and published by independent users and businesses. Aioby is not responsible for the accuracy, legality, quality, or safety of user-generated content. Our liability protections are governed by Section 79 of the IT Act and applicable safe harbour provisions.

If you believe content on the Platform violates these Terms or applicable law, please report it via our Contact page or email legal@aioby.com. We will act expeditiously upon receiving valid complaints.

You must be at least 18 years old to use Aioby. By creating an account, you confirm that you meet this requirement. Businesses must be legally registered and authorised to operate in their jurisdiction and must comply with all applicable local laws and regulations.

• You are responsible for maintaining the security of your account credentials.
• You must not share your account with others or allow others to access it on your behalf.
• You are responsible for all activity that occurs under your account.
• You must provide accurate information when creating your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.
• If you contact a business or Aioby, check out as a guest, or claim a Business Page without signing up first, you agree that we will create a free Aioby account for you using the name, email address and phone number you provide, so you can manage and track your requests and orders. That account starts with a random password you never see; you can set your own at any time with “Forgot password”, and you can delete the account whenever you like (see our Privacy Policy). We do not send you promotional messages through it unless you separately agree to receive them.

Businesses and individuals listing on Aioby agree to:

• Provide accurate, truthful, and up-to-date information about their business, products, and services.
• Not post misleading prices, false availability, or deceptive descriptions.
• Honour commitments made to customers including bookings, orders, and quoted prices.
• Comply with all applicable laws and regulations in their operating jurisdiction, including sector-specific licensing requirements (e.g. RERA for property listings, hotel licensing, educational institution regulations).
• Not list prohibited items including: counterfeit goods, illegal products, weapons, adult content, alcohol (without appropriate licence), tobacco, and any item prohibited under Indian or UAE law.
• Not list regulated professional services (medical, legal, chartered accountancy) in ways that violate the advertising rules of their respective professional councils.

Aioby does not verify the licences, registrations, or accreditations of listed businesses. Users are responsible for verifying a business's credentials before transacting. For property listings, verify RERA registration independently. For hotel/accommodation listings, verify valid tourism licences independently.

Each business is independent and is solely responsible for its own sales. By selling on Aioby, a business agrees that:

• It is responsible for fulfilling orders, packing, shipping and delivery, and for the quality, safety and legality of what it sells.
• It sets its own return, refund, replacement and cancellation policy, shows it to buyers on its Business Page and listings, and honours it. Refunds are made by the seller, not by Aioby.
• It is responsible for its own taxes (including GST where applicable), tax invoices, licences and compliance with consumer-protection law.
• New orders must be confirmed within 4 hours. An order that is not confirmed in time is cancelled automatically. Missed confirmations can earn a strike on the Business Page; three strikes can lead to its listings being suspended.
• If it publishes bank or payment details on its Business Page or website, it does so at its own risk and should share only accounts it is happy to make public.
• Buyers can report a business. Aioby may review reports and take action against the seller — a warning, restriction, suspension or removal of the listing or Business Page.

All users agree to:

• Interact with businesses and other users respectfully and in good faith.
• Post honest, genuine reviews based on actual personal experiences.
• Not attempt to manipulate ratings, post fake reviews, or engage in fraudulent transactions.
• Not use the Platform to spam, harass, threaten, defame, or harm other users or businesses.
• Not impersonate any person, business, or organisation.
• Not scrape, copy, or reproduce Platform content without written permission.
• Not attempt to reverse engineer, hack, or disrupt the Platform or its infrastructure.
• Not use the Platform for any unlawful purpose.

Aioby facilitates transactions between buyers and sellers. By making a purchase on the Platform:

• You agree to pay the listed price plus any applicable taxes or fees.
• Aioby does not charge a commission or a transaction fee on orders between buyers and sellers. In general Aioby does not collect, hold or pass on the money for an order: the buyer pays the seller directly (cash on delivery, bank transfer or another method the seller accepts). Online payment for orders is not generally available. For a small number of sellers that have asked for it and been approved by Aioby, checkout can take payment online through Razorpay and pass it on to the seller; Aioby adds no fee, and returns and refunds for those orders are still the seller’s responsibility — a refund is sent back to the original payment method once the seller confirms it. Aioby’s own optional paid services — plans, Featured Boosts, ad campaigns, wallet top-ups and AI credits — are paid through Razorpay; the price shown is the price you pay.
• For UAE (AED) orders the same applies: Aioby does not process or facilitate any payment. Aioby does not hold a UAE trading licence and is operated from India. UAE orders are cash on delivery, or the seller arranges payment directly with the buyer (e.g. bank transfer or a payment link the seller sends themselves) entirely outside the Platform. Stripe is used by Aioby only for its own subscription billing, not for marketplace transactions.
• Shipping and delivery for all orders, in both India and the UAE, is arranged directly by the seller. Aioby does not handle shipping or logistics.
• Returns, refunds, replacements and cancellations are handled by the business you bought from, under the policy it shows on its Business Page and listings. Aioby does not mediate or decide disputes between buyers and sellers and is not liable for the outcome of any transaction between them. If a seller does not honour its commitments, contact the seller first and, if it is not resolved, report the business — Aioby may review the report and take action against the seller (see section 5A).
• Aioby is not liable for the quality, safety, legality, or delivery of goods and services listed by businesses.

Aioby offers optional paid services to businesses and individuals in India. Creating a Business Page, listing items and receiving customer messages remain free.

• Plans. Growth, Growth Plus and Individual Premium are paid subscriptions for the monthly or yearly period you select. A plan applies to your account and covers every Business Page you own. Benefits are those shown on the Pricing page at the time you buy.
• Renewal. Renewal is optional. It is never selected for you: you choose it yourself, and the amount and interval are shown next to the choice. You can switch renewal off at any time from your dashboard. A plan stays active until the end of the paid period.
• Featured Boosts. A Boost puts one Business Page or listing into featured rotation for the period bought (7, 30 or 365 days). It does not guarantee any position, views, enquiries or sales, and a 365-day Boost means eligible for rotation for a year, not a permanent top spot.
• Ad campaigns. Campaigns are placed in the named placement (for example the home feed, search results, a category page or the homepage) after review. Aioby may reject or remove an ad that breaks these Terms or advertising rules; a rejected campaign is refunded to your wallet in full, and cancelling a running campaign refunds the unused days pro rata.
• Wallet. Wallet balance is prepaid credit for Boosts and ads on Aioby. It has no value outside the Platform and bonus amounts have no cash value.
• Promotion rights. A paid plan makes you eligible to be featured in Aioby's own promotion (posters, social posts, spotlights and similar). Aioby chooses whether, when, how and which eligible businesses to feature at its own discretion. Being eligible is not a guarantee of being featured, and features are not made to order or on request.
• Prices and tax. Prices are shown in Indian rupees and are launch prices that can change for future purchases; the price you accept at checkout is the price you pay. Aioby is not currently registered for GST, so no GST is added; this will be updated if that changes.
• Payment processing. Payments are processed by Razorpay. Aioby does not store your card details.
• Refunds and cancellation. See the Return & Refund Policy (section 8) and the Cancellation Policy.
• Changes. We may change plan benefits or prices for future purchases. We will not reduce the benefits of a period you have already paid for.

Sellers are responsible for their own GST registration, tax invoices, returns and any other tax obligations on their sales. Aioby is not currently registered for GST (see section 7A). If this changes, or if Aioby starts to handle payments for orders more widely, we will update these Terms before it takes effect.

Aioby Points are an in-platform rewards currency. Points may be earned through activity on the Platform and redeemed for discounts on purchases, listing boosts, or premium features within Aioby. Points have no monetary value outside the Platform, cannot be transferred to a bank account or third-party wallet, and cannot be exchanged for cash. Aioby reserves the right to modify, suspend, or terminate the loyalty points programme at any time with reasonable notice.

AI credits are used when an AI feature runs. Free accounts receive a monthly allowance of credits and paid plans receive more; unused monthly credits do not roll over, and credits bought as a one-time bundle are separate and do not expire. Credit costs per feature are shown in the product. Aioby includes AI-powered features (listing description generation, review reply suggestions, translations, price suggestions, semantic search) powered by Google Gemini. These features are provided as suggestions only. You are responsible for reviewing and approving any AI-generated content before publishing. Aioby does not guarantee the accuracy of AI outputs. AI-generated review replies are disclosed as AI-assisted where applicable. When a listing is created, Aioby may automatically adjust its description (for example to work in relevant search terms); you can review and edit it afterwards. Images you upload are checked automatically by Google Gemini for content that is not allowed.

Aioby provides a feature allowing Business Page owners to import their own posts from social media platforms. By using this feature, you confirm that: (a) you own or have the necessary rights to the content being imported; (b) you have the right to republish that content on Aioby; and (c) the import does not violate the terms of service of the originating platform. Aioby is not liable for any intellectual property infringement arising from content you import.

Content you post on Aioby (photos, descriptions, reviews, posts) remains yours. By posting, you grant Aioby a non-exclusive, royalty-free, worldwide licence to display, distribute, and promote that content on the Platform and in marketing materials related to Aioby.

The Aioby name, logo, platform design, and proprietary technology are our intellectual property and may not be used without written permission.

A Deal is a record, kept on Aioby, of the stages of a transaction between a buyer and a seller (agreed, payment recorded, completed) with optional payment proof and return requests. Aioby documents a Deal; it does not hold, guarantee or collect the payment.

A business that publishes a mini website or storefront through Aioby is responsible for its content, prices, products, orders and the personal data it receives from its customers. Customers who order from a storefront are dealing with that business, not with Aioby.

Aioby may display publicly available business information (name, address, category) for businesses that have not yet registered on the Platform. These "unclaimed" listings are clearly marked. If you are the owner of a listed business and wish to claim, update, or remove your listing, please use the "Claim this business" feature or contact us at legal@aioby.com. We will action removal requests within 7 business days.

You must not post, upload, or share content that:

• Is unlawful, defamatory, obscene, pornographic, or harmful to minors
• Infringes any intellectual property rights
• Contains viruses, malware, or harmful code
• Promotes violence, hatred, discrimination, or terrorism
• Is fraudulent, deceptive, or misleading
• Belongs to another person and which you have no right to post, or invades another person's privacy
• Impersonates another person or business, or deceives or misleads about the origin of a message or knowingly shares false or misleading information
• Threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with other countries, or public order
• Violates any applicable law in India, UAE, or the user's jurisdiction

Aioby reserves the right to remove any content that violates these Terms without prior notice and to report illegal content to relevant authorities. We remind users of these rules at least once a year.

Business Pages, listings, posts, ads and other content may be reviewed before or after they go live. Aioby may reject, unpublish, restrict or remove content, and suspend or close accounts, that breaks these Terms, the Community Guidelines or the law. Where we reject or unpublish something you created, we will tell you the reason where possible and, for Business Pages and listings, you can edit it and resubmit for review. Decisions can be questioned through the Contact page or support@aioby.com.

Messaging is covered too. If a conversation is reported, or our automated checks flag it, we may review the relevant messages, warn a member, temporarily restrict their ability to message, or stop them signing in to their account. To appeal a restriction or suspension, email support@aioby.com from the address you signed up with.

Aioby is provided "as is" without warranties of any kind. We do not guarantee the accuracy of business listings, availability of products, conduct of users, or uninterrupted access to the Platform.

We are not responsible for the quality, safety, legality, or fitness for purpose of products and services listed by businesses, nor for any transactions conducted outside the Platform. Use of the Platform is at your own risk.

To the maximum extent permitted by applicable law, Aioby's total liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the amount you paid to Aioby in the 12 months prior to the claim, or ₹5,000 (AED 250 for users in the UAE), whichever is greater.

Aioby is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profit, revenue, data, or goodwill.

In accordance with the Information Technology Act 2000 and the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021, we have appointed a Grievance Officer for India:

These Terms are governed by and construed in accordance with the laws of India and, where applicable, the laws of the United Arab Emirates.

For users in India: disputes shall be subject to the jurisdiction of the courts of Kerala, India. Both parties agree to first attempt resolution through good-faith negotiation or mediation before initiating legal proceedings.

For users in the UAE: disputes shall be subject to the jurisdiction of the courts of Dubai, UAE.

Nothing in this clause limits your rights as a consumer under the laws of your country of residence.

We may update these Terms at any time. We will notify users of material changes by email or via a prominent notice on the Platform at least 7 days before the changes take effect. Continued use of Aioby after changes constitutes acceptance of the updated Terms.
