Terms of Service

By accessing or using Aioby ("the Platform") at aioby.com, aioby.in, or aioby.app, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Platform.

Aioby is a social marketplace platform connecting local businesses and communities in India and the UAE. We operate as an intermediary platform — we are not the seller, service provider, employer, or landlord for any listing on the Platform.

Aioby is an intermediary as defined under Section 2(1)(w) of the Information Technology Act, 2000 (India). Aioby does not initiate, select, modify, or endorse the content posted by users, businesses, or third parties on the Platform.

All listings, posts, reviews, business profiles, and other content on the Platform are created and published by independent users and businesses. Aioby is not responsible for the accuracy, legality, quality, or safety of user-generated content. Our liability protections are governed by Section 79 of the IT Act and applicable safe harbour provisions.

If you believe content on the Platform violates these Terms or applicable law, please report it via our Contact page or email legal@aioby.com. We will act expeditiously upon receiving valid complaints.

You must be at least 18 years old to use Aioby. By creating an account, you confirm that you meet this requirement. Businesses must be legally registered and authorised to operate in their jurisdiction and must comply with all applicable local laws and regulations.

• You are responsible for maintaining the security of your account credentials.
• You must not share your account with others or allow others to access it on your behalf.
• You are responsible for all activity that occurs under your account.
• You must provide accurate information when creating your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

Businesses and individuals listing on Aioby agree to:

• Provide accurate, truthful, and up-to-date information about their business, products, and services.
• Not post misleading prices, false availability, or deceptive descriptions.
• Honour commitments made to customers including bookings, orders, and quoted prices.
• Comply with all applicable laws and regulations in their operating jurisdiction, including sector-specific licensing requirements (e.g. RERA for property listings, hotel licensing, educational institution regulations).
• Not list prohibited items including: counterfeit goods, illegal products, weapons, adult content, alcohol (without appropriate licence), tobacco, and any item prohibited under Indian or UAE law.
• Not list regulated professional services (medical, legal, chartered accountancy) in ways that violate the advertising rules of their respective professional councils.

Aioby does not verify the licences, registrations, or accreditations of listed businesses. Users are responsible for verifying a business's credentials before transacting. For property listings, verify RERA registration independently. For hotel/accommodation listings, verify valid tourism licences independently.

All users agree to:

• Interact with businesses and other users respectfully and in good faith.
• Post honest, genuine reviews based on actual personal experiences.
• Not attempt to manipulate ratings, post fake reviews, or engage in fraudulent transactions.
• Not use the Platform to spam, harass, threaten, defame, or harm other users or businesses.
• Not impersonate any person, business, or organisation.
• Not scrape, copy, or reproduce Platform content without written permission.
• Not attempt to reverse engineer, hack, or disrupt the Platform or its infrastructure.
• Not use the Platform for any unlawful purpose.

Aioby facilitates transactions between buyers and sellers. By making a purchase on the Platform:

• You agree to pay the listed price plus any applicable taxes or fees.
• Payment processing for India (INR) is handled by Razorpay. Payment processing for UAE (AED) is handled by Stripe. Aioby does not store card details.
• Refund and cancellation policies are set by individual businesses. Aioby will mediate disputes where possible but is not liable for the outcome of transactions between buyers and sellers.
• Aioby is not liable for the quality, safety, legality, or delivery of goods and services listed by businesses.

Aioby operates as an e-commerce operator under the Goods and Services Tax Act (India). Where applicable, Aioby collects Tax Collected at Source (TCS) at the rate of 1% on net taxable supplies made through the Platform by sellers, as required under Section 52 of the CGST Act, 2017. TCS certificates will be provided to sellers on request. Sellers are responsible for their own GST compliance and filing obligations.

Aioby Points are an in-platform rewards currency. Points may be earned through activity on the Platform and redeemed for discounts on purchases, listing boosts, or premium features within Aioby. Points have no monetary value outside the Platform, cannot be transferred to a bank account or third-party wallet, and cannot be exchanged for cash. Aioby reserves the right to modify, suspend, or terminate the loyalty points programme at any time with reasonable notice.

Aioby includes AI-powered features (listing description generation, review reply suggestions, translations, price suggestions, semantic search) powered by Google Gemini. These features are provided as suggestions only. You are responsible for reviewing and approving any AI-generated content before publishing. Aioby does not guarantee the accuracy of AI outputs. AI-generated review replies are disclosed as AI-assisted where applicable.

Aioby provides a feature allowing store owners to import their own posts from social media platforms. By using this feature, you confirm that: (a) you own or have the necessary rights to the content being imported; (b) you have the right to republish that content on Aioby; and (c) the import does not violate the terms of service of the originating platform. Aioby is not liable for any intellectual property infringement arising from content you import.

Content you post on Aioby (photos, descriptions, reviews, posts) remains yours. By posting, you grant Aioby a non-exclusive, royalty-free, worldwide licence to display, distribute, and promote that content on the Platform and in marketing materials related to Aioby.

The Aioby name, logo, platform design, and proprietary technology are our intellectual property and may not be used without written permission.

Aioby may display publicly available business information (name, address, category) for businesses that have not yet registered on the Platform. These "unclaimed" listings are clearly marked. If you are the owner of a listed business and wish to claim, update, or remove your listing, please use the "Claim this store" feature or contact us at legal@aioby.com. We will action removal requests within 7 business days.

You must not post, upload, or share content that:

• Is unlawful, defamatory, obscene, pornographic, or harmful to minors
• Infringes any intellectual property rights
• Contains viruses, malware, or harmful code
• Promotes violence, hatred, discrimination, or terrorism
• Is fraudulent, deceptive, or misleading
• Violates any applicable law in India, UAE, or the user's jurisdiction

Aioby reserves the right to remove any content that violates these Terms without prior notice and to report illegal content to relevant authorities.

Aioby is provided "as is" without warranties of any kind. We do not guarantee the accuracy of business listings, availability of products, conduct of users, or uninterrupted access to the Platform.

We are not responsible for the quality, safety, legality, or fitness for purpose of products and services listed by businesses, nor for any transactions conducted outside the Platform. Use of the Platform is at your own risk.

To the maximum extent permitted by applicable law, Aioby's total liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the amount you paid to Aioby in the 12 months prior to the claim, or ₹5,000 / AED 50 (whichever is greater), if no payments were made.

Aioby is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profit, revenue, data, or goodwill.

In accordance with the Information Technology Act 2000 and the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021, we have appointed a Grievance Officer for India:

Response time: Complaints acknowledged within 24 hours and resolved within 15 days.

These Terms are governed by and construed in accordance with the laws of India and, where applicable, the laws of the United Arab Emirates.

For users in India: disputes shall be subject to the jurisdiction of the courts of Kerala, India. Both parties agree to first attempt resolution through good-faith negotiation or mediation before initiating legal proceedings.

For users in the UAE: disputes shall be subject to the jurisdiction of the courts of Dubai, UAE.

Nothing in this clause limits your rights as a consumer under the laws of your country of residence.

We may update these Terms at any time. We will notify users of material changes by email or via a prominent notice on the Platform at least 7 days before the changes take effect. Continued use of Aioby after changes constitutes acceptance of the updated Terms.
